Terms of Service

DBICWebhosting.com has a responsibility to protect each client and to provide the best services available. The following guidelines were designed to ensure these obligations are met:

Content

All services provided by DBICWebhosting.com may be used for lawful purposes only. Transmission, storage, or presentation of any information, data, or material in violation of any United States Federal, State, or City law is prohibited. This includes, but is not limited to: copyrighted material, material judged to be threatening or obscene, material protected by trade secret or other statute, or material that constitutes an invasion of privacy. The subscriber agrees to indemnify and hold harmless DBICWebhosting.com from any claims resulting from the use of the service which results in damages sustained by the subscriber or any other party.

All pornographic content and sex-related merchandising is prohibited on all DBICWebhosting.com servers. This includes sites that may infer sexual content or link to adult content elsewhere. DBICWebhosting.com will be the sole arbiter in determining violations of this provision.

Also prohibited are sites that promote any illegal activity or present content that may be damaging to DBICWebhosting.com servers or any other server on the Internet. Links to such materials are also prohibited.

» Warez sites

DBICWebhosting.com will be the sole arbiter as to what constitutes a violation of this provision.

Commercial Advertising - E-mail

Spamming, or the sending of unsolicited e-mail, from a DBICWebhosting.com server, or using an e-mail address or domain that is maintained on an DBICWebhosting.com sever as reference is strictly prohibited. DBICWebhosting.com will be the sole arbiter as to what constitutes a violation of this provision.

Intellectual Property Violations

Engaging in any activity that infringes or misappropriates the intellectual property rights of others, including copyrights, trademarks, service marks, trade secrets, and patents held by individuals, corporations, or other entities is prohibited. Also prohibited is any activity that violates privacy or publicity rights of others. DBICWebhosting.com is required by law to remove or block access to customer content upon receipt of a proper notice of copyright infringement. It is also DBICWebhosting.com's policy to terminate the accounts of customers who commit repeat violations of copyright laws.

Misuse of System Resources

Any attempt to undermine or cause harm to a server, or customer, of DBICWebhosting.com is strictly prohibited. This includes, but is not limited to: using programs that consume excessive CPU time; allowing the use of mail services, mail forwarding capabilities, or autoresponders other than for the customer's own account; resale of disk space without an appropriate reseller agreement; use of servers for backup of files unrelated to the web site of the account; or resale or remote access to CGI scripts installed on our servers. Operation of IRC servers or IRC bots on DBICWebhosting.com servers will result in an immediate suspension of service.

Other Activities

Engaging in activities, whether lawful or unlawful, that DBICWebhosting.com determines to be harmful to its subscribers, operations, reputation, goodwill, or customer relations is prohibited.

Backups

A backup of all server files is made once weekly. Although every conceivable effort is taken to ensure the integrity of the hosted data, DBICWebhosting.com cannot be held responsible for the loss of data on any Web site. All clients are reminded to keep a current copy of their Web site on their local hard drive.

Cancellation

Cancellation can be made at any time via e-mail by sending a request to support@dbicwebhosting.com. No notice is required, and there is no cancellation fee, but all fees paid for service up to the notice of cancellation are non-refundable. If cancellation is made within the first 30 days of service, all hosting fees can be refunded in some cases. This does not include fees for domain registration or fees on additional features such as additional space or bandwidth. Refunds will not be issued to any client whose account has been deactivated because of Terms of Service violation(s).
DBICWebhosting.com will be the sole arbiter as under what conditions a refund will be issued.

Suspension

Activity which results in a suspension or deactivation of an account will result in a forfeiture of fees paid. Complaints made regarding abuses of an account will be grounds for suspension.

Refusal of Service

DBICWebhosting.com reserves the right to refuse, cancel, or suspend service at its sole discretion. All sub-networks, distributive hosting sites, and dedicated servers of DBICWebhosting.com must adhere to the above policies. Please direct any reports of violations of the above policies to support@dbicwebhosting.com.

Failure to follow any term or condition will be grounds for immediate account deactivation.
Should you decide to engage in a legal battle against DBIC, DBICWebhosting.com or any affiliate or employee of DBIC or DBICWebhosting.com, you agree to pay all legal fees for all parties involved.

Very important addition to our E-Commerce customers:

DBICWebhosting.com can NOT be held responsible for any mistakes like, but not limited to: loss of money, giving false information, over charging customers, within your online store, either made by us, our staff, by you or by your staff, neither for any mistakes occurred through software, hardware or database miss functions or changes.
After adding, changing or removing any information like, but not limited to: Item descriptions, prices, part numbers, pictures, we advise you to NOT taking any orders until the changes have been verified and approver by the store owner.
